This Notice of Privacy Practices explains how AEM Wellness LLC may use and share your health information, how your health information is protected, and how you can access this information.

AEM Wellness LLC currently provides telehealth-only services for patients located in Florida at the time of the visit.

AEM Wellness LLC is required by law to:

• protect the privacy and security of your health information;
• provide this notice;
• follow the terms of this notice;
• notify you if a breach occurs that may have affected the privacy or security of your information;
• not use or share your health information in ways not described in this notice unless permitted by law or authorized by you in writing.

1. Your Rights

You have the right to:

• ask to see or receive a copy of your medical record;
• ask AEM Wellness LLC to correct information you believe is wrong or incomplete;
• ask AEM Wellness LLC to contact you in a certain way or at a different address;
• ask AEM Wellness LLC to limit certain uses or disclosures of your information;
• ask AEM Wellness LLC not to share certain information with your health plan if you paid out-of-pocket in full and the law does not require disclosure;
• ask for a list of certain disclosures AEM Wellness LLC has made;
• receive a paper copy of this notice, even if you received it electronically;
• choose someone, such as a legal guardian or authorized representative, to act for you;
• file a privacy complaint without retaliation.

AEM Wellness LLC may require requests to access, amend, restrict, or disclose records to be submitted in writing or through an approved patient portal process.

2. Your Choices

You may tell AEM Wellness LLC whether we may share information with family members, caregivers, friends, or others involved in your care or payment for your care.

AEM Wellness LLC may use your health information to contact you about appointments, treatment, care coordination, billing, payment, follow-up, patient portal activity, lab or result communication, and other practice-related communications.

AEM Wellness LLC will not sell your health information or use it for marketing when written authorization is required by law unless you provide written authorization.

You may revoke a written authorization at any time by submitting a written request. This will not affect actions AEM Wellness LLC already took based on your prior authorization.

3. How AEM Wellness LLC May Use and Share Your Information

AEM Wellness LLC may use and share health information related to telehealth primary care, medical weight loss, hormone health, laboratory review, medication management, pharmacy communication, referrals, payment, and practice operations as permitted or required by law.

AEM Wellness LLC may use and share your health information for the following purposes:

Treatment

AEM Wellness LLC may use or share your information with providers, pharmacies, laboratories, hospitals, specialists, urgent care, emergency departments, imaging centers, or others involved in your care.

Examples include sharing information to support telehealth care, medication review, lab orders, lab result review, pharmacy communication, referrals, care coordination, or follow-up care.

Payment

AEM Wellness LLC may use or share your information to bill you, process payment, support cash-pay services, collect outstanding balances when applicable, issue refunds or credits when applicable, or communicate about financial responsibility.

If AEM Wellness LLC participates with health plans in the future, AEM Wellness LLC may use or share information for eligibility, claims, payment, utilization review, or other payer-related processes as permitted by law.

Healthcare Operations

AEM Wellness LLC may use or share your information to operate the practice, maintain records, improve care, support billing, train staff, evaluate services, manage patient communication, support compliance, conduct quality review, and manage practice operations.

Business Associates

AEM Wellness LLC may share information with vendors who help operate the practice, such as electronic health record, telehealth, IT, payment processing, patient portal, e-prescribing, laboratory, billing, legal, accounting, credentialing, compliance, website, or administrative vendors.

These vendors are required to protect your information when acting as business associates.

Electronic Communication and Telehealth

AEM Wellness LLC may use electronic health records, patient portals, secure messaging, electronic prescribing, telehealth platforms, phone, video, text, email, electronic forms, and other approved technology to support care, payment, and operations.

Some communication methods may carry privacy risks. AEM Wellness LLC may require secure systems, including the patient portal, for certain protected health information.

AEM Wellness LLC may provide this notice electronically through the website, patient portal, electronic registration, secure electronic forms, email, or another approved method. You may request a paper copy at any time.

4. Other Uses and Disclosures Allowed or Required by Law

AEM Wellness LLC may use or share your health information when allowed or required by law, including for:

• public health and safety activities;
• reporting abuse, neglect, certain diseases, injuries, or adverse events;
• health oversight activities;
• audits, investigations, inspections, licensure, or regulatory review;
• court orders, subpoenas, lawsuits, or legal process;
• law enforcement when permitted or required;
• workers' compensation;
• medical examiners, coroners, or funeral directors;
• organ, eye, or tissue donation organizations, if applicable;
• preventing or reducing a serious threat to health or safety;
• military, national security, or protective services when applicable;

5. Uses That Require Written Authorization

AEM Wellness LLC will obtain your written authorization before using or sharing your information for purposes that require authorization, including:

• most uses of psychotherapy notes, if applicable;
• marketing when authorization is required;
• sale of health information;
• certain disclosures not otherwise permitted or required by law;
• other uses not described in this notice.

You may revoke your authorization in writing at any time. This will not affect actions AEM Wellness LLC already took based on your prior authorization.

6. Sensitive Information

Some health information may have additional privacy protections under federal or state law. This may include behavioral health, reproductive health, substance use, communicable disease, HIV/STI, genetic, minor-related, or other sensitive information.

AEM Wellness LLC will use and disclose this information only as permitted or required by law.

7. Privacy and Telehealth

AEM Wellness LLC provides telehealth-only services currently. Telehealth may involve video, audio, electronic forms, electronic health records, patient portal messages, electronic prescribing, phone calls, text messages, email, and other approved communication methods.

AEM Wellness LLC will take reasonable steps to protect your privacy during telehealth care. You are also responsible for choosing a private location for your telehealth visit when possible.

AEM Wellness LLC may verify your identity and location before or during a telehealth visit.

AEM Wellness LLC may document your telehealth encounter in the medical record.

8. AEM Wellness LLC's Responsibilities

AEM Wellness LLC is required to:

• maintain the privacy and security of your health information;
• provide this notice;
• follow the terms of this notice;
• notify affected individuals following a breach when required;
• not use or share your information other than as described here unless allowed by law or authorized by you.

AEM Wellness LLC may change this notice. The updated notice will apply to all information AEM Wellness LLC maintains.

The current notice will be available upon request and may be made available through AEM Wellness LLC's website, patient portal, electronic intake process, or other approved patient-facing method.
